Older clients often experience legal issues different from younger clients.
Elder law often begins with basic estate planning including trusts
and advanced health care directives in order that a conservatorship or guardianship
is not necessary.
A conservatorship is a court-supervised delegation of a person’s finances.
This occurs only if the individual is incapable of taking care of his/her own
finances. A court appointed conservator has the obligation of paying a protected
person’s bills and handling his/her investments. The conservator must
report revenue and expenses to the court on an annual basis.
A guardianship is a court-supervised delegation of a person’s
care. This occurs only when a person is incapacitated and is unable to care
for himself/herself. The guardian is responsible for ensuring that the protected
person has appropriate care. The guardian has little authority over the finances
of the protected person unless he or she is also the conservator or it is authorized
by the court. The conservator is required to report to the court all of the
significant decisions that the conservator has made for the protected person’s
benefit.
Medicaid is a federal program administered by each state. The rules of each
state vary. The program is designed so that people who need healthcare and are
indigent are able to receive the care they need. We assist people to qualify
for Medicaid. We also assist spouses of potential Medicaid recipients.
