ESTATE PLANNING PHILOSOPHY
We are committed to assisting people in dealing effectively with the certainty
of their death and with the possibility of their mental incapacity. We understand
the peace of mind and monetary savings which a well considered plan can produce.

planning documents as well as estate settlements and trust settlements.
Effective planning can be done only with counseling-oriented attorneys who
take the time to review asset ownerships (single, joint, corporate, or trust),
asset valuations, primary and secondary beneficiary designations, the potential
receipt of future assets, and then take into consideration various factors such
as:
1. Asset management during disability.
2. Will vs. Trust considerations.
3. Estate tax issues.
4. Tax deferral alternatives.
5. Asset protection from creditors or divorcing spouses of
beneficiaries including children or remarried
spouses.
6. The age beneficiaries should receive assets.
7. Special needs of beneficiaries.
8. Guardianship preferences.
9. Intentions for specific bequests.
10. Cost reduction of transfer upon death.
11. Business succession.
12. Certainty as to outcome
An estate planner must have a broad understanding of a range of estate planning
tools including powers of attorney, advance medical directives, wills, revocable
trusts, irrevocable trusts, gift planning, 529 plans, retirement plans, buy-sell
agreements, insurance trusts, charitable giving programs, limited liability
companies and others.
Planning for contingencies such as changes in the form of assets or future
asset acquisition or the unexpected death or disability of a beneficiary is
extremely important as death frequently does not occur in the expected order.
Inadequate planning, lack of asset ownership/beneficiary coordination, and
wrongfully assuming that beneficiary will dispose of an asset in a particular
way are major reasons that goals frequently are not achieved.
Organizing information, including that relating to smaller assets, is key to
easy periodic review during lifetime and transfer after death.
